Website Blocking

The government can order service providers to block websites for infringing links posted by any users.

Risk of Jail for Ordinary Users

Chaos for the Internet

“We support the bill’s stated goals — providing additional enforcement tools to combat foreign ‘rogue’ websites that are dedicated to copyright infringement or counterfeiting,” the Internet companies wrote in Tuesday’s letter. “Unfortunately, the bills as drafted would expose law-abiding U.S. Internet and technology companies to new uncertain liabilities, private rights of action and technology mandates that would require monitoring of websites.”  The chamber-led coalition in support of the bill includes Walmart, Eli Lilly & Co. and Netflix.

Google and other opponents of the legislation argue that restricting the Internet in the U.S. sets a bad international precedent and that the language defines infringing too broadly.



This is scary. I'm not talking about what some people have dismissed this as: "Oh, you're just mad because it'll stop you from downloading movies and music for free!" A vaguely written law that gives government the ability to decide what websites you can go to? That's a huge blow to free speech in America, how could that not be?

And I suppose this part depends on your opinion on vidding but I personally believe it's a valid art form. It's a means of remixing video and music in a way that is uniquely your own vision. I've never seen a vidder try to claim that they personally filmed the movie/show or created the music. Vidders don't make money off their vids (at least, none that I've ever met; being the Internet, you learn never to assume that somebody hasn't tried something crazy by now ;) ). Vids are for entertainment and for your own expression. But under these bills, not only would it become impossible to share your own vids with anybody if you're in the US, it would be illegal to watch vids as well.

Any site that allows user-generated content would have to be monitored heavily to make sure that somebody doesn't upload something "infringing," whether it's a song playing in the background while you're filming your dog doing something cute or whatever. User-generated content would basically have to STOP for most websites because the penalty would be too high if something got through.

This is really ridiculous, in my opinion. I'm not saying that the movie/TV show/music copyright holders don't have a right to not want their material pirated. Of course they do. But this net they're trying to cast is so very broad that it's not going to just catch people pirating movies and music and all of that. It's going to target everybody who has ever used copyrighted material, no matter in how much of a NOT "Here, I'm helping you to illegally obtain this content!" way.

I didn't get interested in Doctor Who until I started seeing vids for it. I didn't watch it because the commercials made me want to see it, I got interested from what vidders had to say about it. I'd hate to even tell you how much I've spent now on DVD sets and merchandise that the copyright holders never would've seen from me if not for those vids. There have been songs that I disliked on the radio and would never have bought for its own sake. Then I saw a great vid using that song and suddenly... I really like it. My opinion flipped completely and solely because of a vid. Vids are great promotional tools provided for free and out of sheer love from fans of a show or band. They don't take the place of legally buying the products they promote.

But regardless of how you feel about the legalities of vidding, the bottom line is that whenever you're ready to implement censorship in such a broad way, it's a very bad, scary and troubling step to take. You think this doesn't affect you if you're not a vidder or if you're not in America? If this passes, then just you wait and see. You'll be next.
